1. General and Applicability
1.1. This document (hereinafter: the "Terms") governs the terms of use of the website operated by GeoTwins Technologies, Limited Partnership, and the companies affiliated with it (hereinafter: "the Company").
1.2. The provisions of these Terms and the privacy protection policy appearing on the Site, as detailed below, constitute a binding legal agreement between the User and the Company. Any use of the Site is subject to the provisions detailed in this document.
2. Definitions
In these Terms, the following expressions shall have the meaning set out beside them, unless the context requires otherwise:
2.1. "The Site" or "the landing page": the web interface, the digital pages and the computerized systems operated by the Company for presenting the Company's activity and collecting data.
2.2. "User": the user of the Site, whether he provided his personal details or not.
2.3. "Personal information": as defined in the Protection of Privacy Law, 5741-1981, including name, ID number, contact details, organizational affiliation and any other datum that identifies the User.
3. Agreement to the Terms of Use
3.1. The very act of entering the Site, browsing it and using the services offered on it constitutes confirmation by the User that he has read the Terms and the privacy policy and that use of the Site is subject to them.
3.2. The User declares that he has read the Terms carefully, understood their content, and in particular the Company's privacy policy, and that he agrees to them without any reservation.
3.3. To the extent the User does not agree to any of the Terms, he must immediately cease all use of the Site.
4. Changes and Updates to the Terms
4.1. The Company reserves the right to change, update, add to or detract from the provisions of these Terms from time to time, at its sole discretion and subject to the provisions of applicable law.
4.2. The binding version of the Terms is the version published on the Site at the time of use of the Site. The User must review the Terms each time he performs a new registration or action on the Site.
4.3. Material changes to the Terms will be published on the Site and will take effect from the date of their publication, unless otherwise determined. Continued use of the Site after an update of the Terms will constitute the User's agreement to the updated version.
Use of the Site, Liability, Limitation of Liability and the Company's Rights
5. Terms of Use and Limited License
5.1. Use of the Site, including the landing page and the various systems, is permitted for lawful purposes only and is intended solely for getting acquainted with the Company and its products and for contacting the Company.
5.2. The Company grants the User a limited, personal, non-transferable and non-exclusive license to use the Site for reviewing its content, getting acquainted with the Company's activity and contacting it via the means offered on the Site. Any other use of the Site, including unauthorized commercial use, is prohibited.
5.3. The User undertakes not to make any use of the Site in a manner that may impose an unreasonable load on the Site's servers, disrupt its proper operation or harm the user experience of other participants.
6. Prohibited Actions on the Site
6.1. The User is absolutely prohibited from performing the following actions, by himself or through anyone on his behalf:
- Providing false, misleading or inaccurate details, including impersonating another person or registering in the name of another employee without express written authorization.
- Copying, distributing, publicly displaying, transmitting to the public, modifying, processing, creating derivative works of, selling or leasing any part of the Site or the content appearing on it.
- Using robots, crawlers, or any other automated means for collecting information from the Site or for performing fictitious registration actions.
- Introducing viruses, Trojan horses, worms or any other malicious software that may harm the Site, the Company's computing systems or the information stored in them.
- Performing reverse engineering, decompiling or attempting to discover the source code of the Site or of the operational systems serving it.
6.2. The Company reserves the right to block the access of a participant who breaches the provisions above, without derogating from any other remedy available to it under any law.
7. Information Security and User Responsibility
7.1. The User undertakes to report to the Company without delay any concern of unauthorized use of his details or any breach of information security on the Site brought to his knowledge.
7.2. The Company will not be liable for any damage caused to a participant or to a third party as a result of unauthorized use of the User's access means, to the extent this resulted from the User's negligence in maintaining the confidentiality of his details.
8. Site Availability and Maintenance
8.1. The Company acts to the best of its ability to ensure the proper and continuous availability of the Site. However, the Site is made available to the User "AS IS" and on an "AS AVAILABLE" basis.
8.2. The User declares that he is aware that the Site's operation depends on technological factors that are not under the Company's full control, such as communication providers, cloud services and internet infrastructure. Accordingly, there may be disruptions, malfunctions, temporary shutdowns or unavailability of the Site.
8.3. The Company may temporarily suspend the operation of the Site for maintenance work, version updates, fixing malfunctions or improving the service, and the participant will have no claim or demand in respect of such suspensions.
9. Limitation of Liability
9.1. The Company, its managers, employees or anyone on its behalf will not be liable for any direct, indirect, consequential, special or punitive damage arising from the use of the Site or from the inability to use it.
9.2. Without derogating from the above, the Company will not be liable for any error or corruption in data entered by the User. The responsibility for verifying the correctness of the details provided in the inquiry or contact rests with the User.
9.3. The Company is not responsible for any damage caused as a result of the User's reliance on incorrect or incomplete information provided by him.
9.4. In any event, to the extent liability of the Company is determined in connection with the use of the Site, its total liability towards the User will be limited to a direct and reasonable amount attributable to such use, all subject to applicable law.
10. Intellectual Property
10.1. All intellectual property rights in the Site, including copyrights, trademarks, graphic design, Site structure, computer code, the digital forms, the content and the operational systems, belong exclusively to the Company or to third parties who granted it a license to use them.
10.2. Nothing in the use of the Site or in performing the registration grants the participant any proprietary or other right in the Site's content or its infrastructure, beyond the limited right of use detailed in these Terms.
10.3. It is prohibited to use the Company's trademarks without obtaining express written consent from the Company.
11. Changes to the Site and the Terms of Use
11.1. The Company reserves the right to change, update, add to or detract from the Site's content, its structure, its design and the manner of performing registration, at any time and at its sole discretion, subject to the provisions of applicable law.
11.2. The Company may update the Terms of Use from time to time. The binding version of the Terms is the version published on the Site at the time of use. The User is advised to review the Terms from time to time, and in particular before providing details via the Site or contacting the Company.
